Marrying an Indian Student in Germany
By Venkata Nagireddi, Founder & CEO, NRI Hearts (Atlanta, GA)
Often the partner in Germany is doing a master's degree there. A student permit does allow a spouse to join, but the rules are stricter than for a working partner, and the date of the wedding matters more than families expect.
Can the spouse of a student join them in Germany?
Yes, usually, if the couple was already married when the student's permit was issued and the student's stay is expected to last more than a year. If the marriage came later, the German Missions in India say the decision is at the officer's discretion; after two years on a residence permit, the rules can be easier.
The condition is in §30(1) of the Residence Act. The German Missions in India explain the discretion for marriages after the visa in their FAQ. Enough living space (§29) and a secure livelihood for both are also expected.
Does the spouse of a student need A1 German?
Yes. Students are not on the list of permits whose spouses are exempt, so the spouse must show A1 German before the visa is issued, unless a personal exemption applies.
The exemption list is in §30(1) of the Residence Act. See our Germany spouse visa guide for advice on the A1 exam.
How does the student's own visa work?
Indian students usually show €11,904 in a blocked account, from which €992 a month is released. That money covers the student, not a spouse, so a family needs separate funds or income.
The amount is on the German Missions in India study page. Students may also work up to 140 full working days a year under §16b(3) of the Residence Act, which rarely covers a second person on its own.
What happens to the spouse after the student graduates?
After graduating from a German university, the student can stay up to 18 months to find a job. Once they move to a skilled worker permit or a Blue Card, the spouse no longer needs A1 German for a new application.
The job-search period is in §20 of the Residence Act. The table shows how each stage affects a spouse.
| Student's stage | Spouse can join? | Spouse needs A1? |
|---|---|---|
| Studying, married before the permit | Usually yes, if staying over a year | Yes |
| Studying, married after the permit | Discretionary; can be easier after two years on a permit | Yes |
| Working on a Blue Card after graduating | Yes | No |
| Working on a skilled worker permit (§18a/§18b) | Yes, subject to §30 conditions | No |
Should the couple marry before or after the degree?
That is a family decision, but the law rewards planning. Marrying before the student permit is issued makes joining more straightforward, while waiting for a work permit removes the A1 test.
Talk it through openly in the match conversation: how many semesters remain, the job plan after graduation, and whether the couple is prepared to live apart for a while.
What should the family confirm before the wedding?
Confirm the course, the expected end date, the type of residence permit and how the couple will be supported. A student permit is printed on the residence card, so asking to see it is reasonable.
